Choctaw County Warrant Records Choctaw County Warrant Records

Start with the paper, then with the clerk whose court is named on it. A Choctaw County bench warrant means a judge's order, usually from Justice Court in Ackerman, a town court, or Circuit Court, after something the court expected simply did not happen. A missed appearance. An unpaid fine. An ignored order. When you call, ask three things: whether the process was issued, whether it has been returned or recalled, and what the court will accept to resolve it. Those words carry different meanings. A lawyer can sometimes file a motion before anyone has to appear, so ask about that too.

Choctaw County Bench Warrants Explained

The name fits the furniture. A judge signs a bench warrant from the bench itself, without any officer applying for one first. Something the court counted on went missing. Maybe a defendant skipped a hearing. Maybe a fine sat unpaid past its deadline, or an order about reporting or filing went unheeded. Contempt and default sit in the same family of cases. Mississippi courts also use the word capias for a process ordering custody of a person, and capias pro fine shows up when the root problem is money owed to the court. The label matters, because the fix differs. Rather than guessing, ask the Choctaw County clerk which term actually appears on the docket.

Where Choctaw Bench Warrants Begin

Most lower court work in Choctaw County moves through Justice Court at 140 Jail House Road in Ackerman. Judge Lacee Black Jones holds Post 1 and Judge Teresa Weeks holds Post 2, with Clerk Katelyn Newman serving both posts on the 662-285-3599 line. Per the state judiciary directory, Justice Court handles civil matters generally under $3,500 along with limited criminal jurisdiction, so misdemeanor cases, traffic citations, and failure to appear matters land there. Ackerman Municipal Court runs town ordinance and limited criminal cases on its own track, while Circuit Court sits above both for felonies. Choctaw County terms last three weeks from the Tuesday after the third Monday in February, then three weeks from the third Monday in August. That schedule explains why no judge may be reachable on a given weekday.

How Choctaw County Bench Warrants Are Issued

Picture the sequence before you pick up the phone. A court sets a date or an obligation. The date passes with no appearance and no payment. The judge directs a process, the clerk prepares it, and an officer receives it for service. Missed setting, judicial direction, process issued, then served or recalled, and the case resumes. The Justice Court Clerk's statutory duties include issuing criminal warrants at the judge's direction. That is exactly why the clerk, not the sheriff, is the right first call in Choctaw County. The sheriff, a constable, or a municipal officer executes what the clerk issues, then files a return with the court.

Choctaw County Bench Warrant Terms

Four words come up in nearly every Choctaw County bench warrant call, and callers mix up two of them constantly. Learning the difference before dialing turns a vague exchange into an answer you can actually use.

Issued
The judge directed the process and the clerk created it. It is open until something changes that.
Returned
An officer filed a return of service recording how and when the process was executed. This is not the same as the court withdrawing it.
Recalled or quashed
The court withdrew the process. Ask for a docket entry or written proof, because other systems may lag behind the courtroom.
Alias capias
A later process issued after an earlier one or after a repeat appearance problem. The exact use depends on the court.

Note: write down the clerk's exact phrasing on any Choctaw County status, since a paraphrase can flip its meaning.

Bench Warrants and Arrest Warrants Compared

From the outside the two processes look alike. In practice they behave differently in almost every way that matters for resolving one. A bench warrant grows out of a case that already exists. An arrest warrant starts a case, or adds a charge to one, based on a sworn accusation.

Payment and Choctaw County Warrant Recall

Here sits the costliest assumption in this whole area. Paying the underlying citation through the county's online portal settles a balance, nothing more. It does not establish that a judge withdrew a process already issued on that same case. The payment screen is a vendor interface tied to a citation record. The recall happens in the courtroom and shows up in the docket. Before treating the matter as closed, ask the clerk three questions. Does the amount shown include all costs? Does payment recall the process? Is a court date still on the calendar? Then ask how Choctaw County documents the clearance, and keep whatever paper it issues.

Resolving a Choctaw County Bench Warrant

Choctaw County publishes no recall form, motion template, filing fee, standing warrant docket, or bond schedule. Do not fill that gap with a generic form downloaded from somewhere else. The procedure is whatever the issuing clerk says it is the day you call, and a lawyer is often the fastest route to that answer.

Before you act: time does not expire a bench warrant. Moving out of Choctaw County does not clear it. Partial payment on a balance does not recall it. Get written or docket confirmation of any resolution.

Ask whether a Choctaw County court accepts a voluntary appearance. Ask whether counsel can file a motion to recall or quash, and whether a bond applies. Ask what identification and payment forms the office takes.

A Missed Date and a Choctaw Warrant

Someone realizes on Thursday that a Tuesday setting came and went. The instinct is to wait it out. Call the same day instead. A Choctaw County court hearing from a person voluntarily sits in a very different posture than one waiting on an officer to make contact.

  1. Pull the citation, summons, or notice and read the court name and case number off it.
  2. Call that clerk and say the appearance was missed and you want to correct it.
  3. Ask whether a bench warrant or capias has issued and what the court needs.
  4. Ask whether a reset date, a payment, a hearing, or a motion is the right path.
  5. Ask whether counsel should appear first, then follow that instruction rather than driving over unannounced.

Finding the Court That Issued the Warrant

Lost the paperwork? Work down from the most likely level. A citation or traffic notice points to Justice Court or a town court. A felony complaint or indictment points to Circuit Court. A town ordinance matter points to the municipality itself. Chancery handles a different kind of case entirely, though a chancery contempt process routes by its own cause number in Choctaw County.

Town Courts and Choctaw Bench Warrants

Only Ackerman shows a municipal judge entry in the 2026 state judiciary directory, and the listing names Judge Kasey Burney Young at 662-840-9185. French Camp, Mathiston, and Weir appear in the state municipal government directory as incorporated places. None of the three carries a judge listing for the current year. That gap is a routing question, not a conclusion. A town without a listed judge can still write citations, and those papers get filed somewhere. Only the town clerk can tell you where. Mathiston adds a wrinkle, since the town straddles the Choctaw County line and spills into the next county over. A Mathiston resident chasing a bench warrant might be calling the wrong county entirely, so confirm the issuing court before anything else.
